Unless Don can reach an agreement with Karl Welz, I am going to have to do a global Search and Replace on the EW Database and replace every instance of ‘Orgonite’ with ‘Orgone-ite’ or some similar variation. And probably install some periodic program that keeps the word out off the site.

Our only alternative is to raise money to hire our own Attorneys and bring a counter Suite against Karl Welz under the argument that ‘Orgonite’ is a word in the public domain to the extent to invalidate his claim, as in what has happened with other ‘words’ previously trademarked.

Being that this is a grassroots, un-organized by design, community, I don’t think it practical to bring a suite, but rather simply to popularize some other word and be done with it.

I am going to have to do this soon, before my friends and colleagues, owners of the ISP where I host the site, force my hand in self defense.

Capt Azti, since I own the site I wonder why anyone’s having this discussion with you. I"ve never heard from Karl or his lawyer about this. If he asked me to make that change, I probably would, but in real terms his business has probably increased on account of so many people spreading orgonite around. I’ve always given him credit, and very often, for being the source of the idea for all of us. I don’t mind changing all the words on the site to ‘OrgOnite’ but that’s a lot of work for you, so if it’s not really necessary maybe we can just leave it alone unless this escalates. I’ve never seen it get beyond the threat stage.

For seven years his lawyer has been sending threatening emails (?) to a few orgonite vendors but I suppose that if it were a clear case of trademark infringement somebody would have ended up in court or in a lawyer tug of war. I sympathize with any inventor who feels his turf is threatened by a grassroot movement. I don’t know how we came to use the word, ‘orgonite.’ Several folks who seem to know something have assured us that it was in widespread public use before Karl applied for a trademark. DB came up with the word, ‘gifting’ for what we do. The newagyness of the word is eclipsed, for me, by the dynamically substantive nature of the work

Maybe I just don’t have enough info about the current lawyer dance, though–you and I started discussing this in emal but I just wanted to put my two bits in the thread.

Don, they go after the NETWORK providers if the Owners are unresponsive. Of course he really doesn’t have a leg to stand on, and absolutely Welz has benefited MUCH more than being hurt in any way. I don’t understand why he sicks his attack dogs out this way, on a fruitless crusade, when he’s being benefited. He’s blowing his hard earned cash on Attorneys rather than on things he wants to do! In any case, the issue is not that you can call his bluff successfully, you have; the issue is whether the sites Internet Provider will call their bluff. They don’t know the history, are not engaged in the movement, nor is there any business advantage for them to support EW and to call Welz’s bluff. If threatened, despite my contracts with them and my long friendship and association, they will act to protect their business.

I can probably stall for a while and see what happens but I feel this is likely a fight not worth fighting. We have other fights that are REALLY worth fighting. As to work for me to change things, there’s hardly any work; it is simply a global search and replace on a SQL database, against a single, discrete, word–a trivial exercise…

Whats really curious is that he’s spending no time promoting his product.

All the seed growth experiments don’t take long to do and would be a great selling point.

This is just my two cents.
Let the ISP sort it out and follow their recommendations or change internet service providers. The march by TPTB to suit ISP’s over hosted content isn’t going away as it’s a powerful tool to limit free speech. It’s just a big stretch for me to swallow that Karl Welz or anyone else can tell an unorganized forum of writers that they can’t write the word orgonite in any of their posts. I’m not sure, but the person who wrote me on behalf of Karl Welz to ask me to remove the word orgonite from http://www.ultimatevision.us last fall wasn’t Karl Welz’s Attorney, but someone from Karl’s hosting company doing Karl’s dirty work. Using a $15.00 an hour customer service rep to scare me with the threat of a lawsuit tells me a lot about how serious Mr.Welz is about going after folks who use the word orgonite on the web.
Do what you must Azti, I support whatever choices you have to make to have the ew safe, secure and up on the internet.

Regarding your ‘2 cent’s worth’:

I acknowledge your opinion on this matter as it’s been your consistent position regarding this controversy. In fact I was waiting for this outburst; knowing it would come.

Regarding the hosting company; frankly, your wrong… I am a seasoned professional in this Industry, an INSIDER from nearly the beginning. I have a LOT of both influence and authority within this Hosting Company, and some influence and friendships within the Management of the Multi-Billion dollar Facility within which this hosting company operates. I am able to protect EW MUCH, MUCH, MORE Than ANYONE EVER HAS. You want EW subjected to a chain of shoddy, ill conceived, stranger’s company’s, one after another? To be tossed out at their whim? To have no control, or even influence, over the network under which we host (AND I HAVE!)? To be some beggars at some nameless ISP in some backwater? To not have any influence or inside position? No consideration other than a contract that is meaningless to protect EW due all of the out clauses any ISP has? What are you saying? That you would rather spite this old man Welz than do the smart thing, what benefits ALL OF US?

Yes, Welz is an old man, and feeble and feckless SO WHAT! The issue is what fights to pick. You advocate picking this one? Why? What does it win the 0rognite gifting movement to endanger MY RELATIONSHIP with this company on behalf of EW? For WHAT! Because you despise the poor old man? Get a grip and decide who your enemies are… Welz is NOT our enemy. He’s a hapless victim of his own ignorance and apparent feebleness. Save your invective and bile for the miscreants who enslave us.

I honor your work, your courage and gifting; your BALLS in the face of this hidden struggle in which we engage; however, in this case, with all due respect, what your are suggesting is foolish.

Of course, it is entirely up to Don and Carol what they choose to do. However, at this point they are being students of Sun Tzu and have entrusted me to do what is required to protect EW; to do what is prudent in this matter.

Regarding hosting outside of the US… Where do you think it is safe? Do you think there is ANY principalities outside of the reach of the Miscreants? Better to operate within the Belly of the Beast, in your own fortification and capacity to defend yourself, than the false security of some obscure country’s hosting environment. If they trash, physically, EW’s current situation they TRASH some of their OWN operations. What better place to be?

My advice to you regarding Welz, (My own 2 cents), and for what it’s worth, is to relax, take a deep breath, and FORGET about this old man Welz. Leave him be and lets all get on with it. In fact, I hope to make a bunch of 0rgonite soon and gift the hell out of Loudoun County, VA. Come on over and help me as you are just over the border in MD.

Eric, sincere congrats for taking a stand, that way. I love the ‘nothing to lose’ attitude and that’s what inspired me to do what I’ve done over the past ten years, too. I do wish Karl Welz well and will continue to promote him–why wouldn’t I? I’d promote DeMento if he actually did anything worthwhile, though he does have a few pretty good products on his website. When DeMento crossed the line and tried to influence the Mozambique court to give prison sentences for Georg, Tino, Carlos and Prophet (for their gifting) he put himself squarely in the little Rogues Gallery, though. History is and ought to be a heartless bitch when it comes to recording our foul deeds.

Capt Azti’s acid test came a few weeks ago when several substantive websites (and Rense’s [Image Can Not Be Found] ) were thrown down by NSA parasites. The previous destructions of EW, including physical sabotage at the hosting facilities in Canada and Chile, really hurt us because a whole lot of historic posts were essentially lost, in each case. When he finally got EW back online, after at least one sleepless night for Chuck and a whole lot of hours, not to mention an anomalous fire at the facility [Image Can Not Be Found] nothing was lost. I don’t know if we mentioned that the hosting facility outside of Washington, DC, also hosts some CIA shell companies’ websites. If that weren’t so, maybe the destruction of EW would have been successful. Capt Azti’s brilliance was confirmed and displayed.

I mentioned, before, that a few hours before these sites were sabotaged, Jerry Kane and his child were gunned down by 80 federal (!) cops in Arkansas. His inexcusable crime was that he was teaching people how to get out from under predatory lenders and bank fraud, which is the foundation of the corporation that’s posing as the federal gov’t. The fact that these are on the internet is evidence enough, for me, that the world order has weakened sufficiently enough that CIA/NSA censorship of their own internet assets has become counterproductive. They do censor some of our stuff from YouTube, by the way.

I think we’re going to appreciate the Captain’s innovative and elegant solution which honors Karl Welz even more.

It has been 15 days since my ISP received the Notice from W3lz’s Attorneys. We have not heard anything subsequent. Moreover, and more importantly, I’ve not had any pressure from my Friends that own the ISP to remove the ‘word’. I became seriously distracted with ‘Family Drama’ immediately after my original post and was delayed in writing the code to make the changes. Since nothing has happened since, and I was thinking about this today, I have come to believe that we can afford to wait it out a bit, and see what happens as we are not in any imminent danger.
